Tinjauan Hukum dan HAM terhadap Kasus Perdagangan Organ Ilegal pada TKI di Kamboja

Penelitian ini mengkaji peningkatan kasus perdagangan organ ilegal yang menimpa Tenaga Kerja Indonesia (TKI) di Kamboja pasca-pandemi COVID-19. Banyak korban terjerat modus penipuan berupa tawaran pekerjaan bergaji tinggi, namun kemudian dipaksa menjual organ tubuh mereka, bahkan hingga meninggal dunia. Penelitian ini dilakukan menggunakan metode studi literatur, menganalisis jurnal, laporan, dan studi kasus dari sepuluh tahun terakhir. Hasil analisis menunjukkan bahwa beberapa faktor utama yang menghambat perlindungan hak TKI adalah lemahnya pengawasan hukum, keberangkatan ilegal atau non-prosedural, serta perbedaan sistem hukum antara kedua negara. Kasus Soleh Darmawan menjadi contoh nyata dari tindak pidana perdagangan manusia (TPPO) ini, yang tidak hanya melanggar hukum nasional tetapi juga hak asasi manusia mendasar, seperti hak hidup, kebebasan, dan integritas tubuh. Oleh karena itu, penelitian ini menekankan pentingnya peningkatan literasi hukum bagi calon TKI, penguatan kerja sama bilateral, serta pengoptimalan peran lembaga berwenang seperti pemerintah dalam mencegah kasus serupa di masa depan dan menegakkan hak asasi manusia warga negaranya.
